As you can see, one of the major changes of AB 167 is to clearly authorize the use of independent study for students on COVID-19 quarantine.
Independent Study Board Policies: Charter schools that have not previously adopted a board policy for independent study will need to do so prior to collecting any apportionment for independent study. Charter Schools that have already adopted a board policy for independent study but who did not update the policy for AB 130 or AB 167 will need to do a significant update to their policies to align with both pieces of legislation. Charter Schools who already updated their independent study board policies for AB 130 will likely need to do a minor update to their adopted independent study board policy to reflect the use of independent study for students on COVID-19 quarantine and to reflect updated language from AB 167 regarding tiered re-engagement strategies.
Written Independent Study Agreements: AB 167 provided additional time for the signature of written independent study agreements no later than 30 days after the first day of instruction in an independent study program or October 15, whichever date comes later.
ADA from Independent Study for Quarantined Students: Independent study ADA for quarantined students is not counted toward the 20% which could alter the characterization of a charter school from a classroom-based charter school to a nonclassroom-based charter. As such, ADA from Independent study for quarantined students should be separately tracked internally unless and until the State gives us a tracking mechanism to distinguish the quarantined independent study from the remainder.
